Szanując prawa i wolność osób, których dane przetwarzamy oraz spełniając obowiązek wynikający z Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (dalej: RODO),informujemy:

Administratorem danych osobowych jest Stowarzyszenie Trefl Pomorze z siedzibą przy Placu Dwóch Miast 1w Gdańsku (80-344), NIP 5851454301.

Administrator wyznaczył inspektora ochrony danych, z którym można się kontaktować we wszystkich sprawach związanych pośrednio lub bezpośrednio z ochroną danych osobowych:

·       korespondencyjnie – kierując zapytania na adres Administratora, z dopiskiem „Inspektor ochrony danych”

·       drogą korespondencji elektronicznej na adres: iod@trefl.com  

W jakim celu, przez jaki czas i czyje dane osobowe przetwarzamy.


Dane osobowe przetwarzamy w następujących celach:


Nawiązanie kontaktu


Przetwarzamy dane osób, które przekazały do nas zapytanie: poprzez formularz kontaktowy, telefonicznie, pocztą elektroniczną lub pocztą tradycyjną. Udzielenie odpowiedzi stanowi prawnie uzasadniony interes Administratora więc dane osobowe są przetwarzane w tym procesie na podstawie Art. 6 ust. 1 lit. F) RODO. Korespondencja jest przez nas przechowywana do terminu rozwiązania sprawy i zakończenia kontaktu. Jeżeli przedmiotem korespondencji był temat, który może skutkować pojawieniem się roszczeń, wówczas taką korespondencję do celów dowodowych przechowujemy przez okres 12.miesięcy.

Zgłoszenie uczestnika i płatność.


W tym celu przetwarzamy dane osobowe uczestników wydarzeń i ich rodziców/opiekunów prawnych. Dane osobowe są niezbędne do przygotowania umowy na organizację wypoczynku lub zajęć sportowych (w zależności od charakteru wydarzenia) i zostają podjęte przed zawarciem umowy na żądanie osoby, która będzie jej stroną (Art. 6 ust. 1 lit. B RODO).  Takie dane przetwarzamy przez czas obowiązywania umowy a następnie do terminu przedawnienia roszczeń jakie mogą wynikać z tytułu jej zawarcia.  

Wysyłka informacji organizacyjnych.


Na numer telefonu podany w formularzu rezerwacji będziemy przesyłali informacje organizacyjne w formie sms. Podstawą przetwarzania danych w tym celu jest uzasadniony interes Administratora (Art. 6. ust. 1 lit. f) . Jeżeli Pan/i nie życzy sobie otrzymywania informacji w tej postaci - prosimy o przekazanie sprzeciwu na adres email Inspektora ochrony danych. Dane w tym celu przetwarzamy przez czas od otrzymania rezerwacji do zakończenia wypoczynku lub zajęć sportowych albo do terminu odebrania informacji o rezygnacji uczestnika z udziału.

Newsletter

Jeżeli zapisał/a się Pan/i do naszego newslettera, to przetwarzamy Pani/Pana dane osobowe do celu jego wysyłki. Dane osobowe są przetwarzane w tym celu na podstawie zgody (Art. 6 ust. 1 lit. A RODO) do terminu jej odwołania lub do ukończenia przez Państwa dziecko 18-rokużycia.  Newsletter nie będzie także wysyłany osobom, które przez okres 2 lat nie skorzystały z ofert Administratora– adresy email takich osób zostaną usunięte z listy mailingowej.


Kto może uzyskać dostęp do danych osobowych.

Dane osobowe mogą zostać ujawnione organom władzy publicznej w zakresie i w celach, które wynikają z przepisów powszechnie obowiązującego prawa, jak również podmiotom, które na podstawie stosownych umów podpisanych z Administratorem przetwarzają dane osobowe.:

·       dostawcom usług hostingowych, w tym poczty elektronicznej i oprogramowania CRM,

·       dostawcy usługi – bramka sms,

·       radcy prawnemu w przypadku pytań natury prawnej lub wstąpienia na ścieżkę dochodzenia roszczeń,

·       dostawcom wspierającym obsługę stron internetowych.

Ponadto, jeżeli będzie Pan/i dokonywała płatności online za wypoczynek lub zajęcia sportowe – dane osobowe udostępnimy operatorowi płatności. Udostępnienie danych osobowych jest ograniczone do danych niezbędnych dla poprawnego przeprowadzenia transakcji płatniczej.

Czy Administratorzy przekazują dane osobowe do Państw Trzecich.


Administrator przekazuje do Państw trzecich jedynie anonimowe informacje zebrane przez pliki cookies dostarczane przez Google LLC(lista poniżej) w ramach usługi Google Analitycs i Google Tags. Informacje o przetwarzaniu tych danych przez Google LLC są dostępne na stronie WWW: https://policies.google.com/privacy


Z jakich praw może skorzystać osoba, której dane osobowe przetwarzamy.


W dowolnym momencie może Pani/Pan wystąpić z żądaniem wykonania swoich praw:

1.      dostępu do danych w określonym przez przepisy RODO zakresie (art. 15 RODO),

2.      sprostowania danych (art. 16 RODO),  

3.      żądania usunięcia danych w przypadku spełnienia jednej z przesłanek wskazywanych przez przepisy RODO (art. 17 RODO),

4.      ograniczenia przetwarzania danych w określonych przez przepisy RODO przypadkach (art. 18RODO),

5.      przeniesienia danych (art. 20 RODO),

6.      wniesienia skargi do organu nadzorczego, którym jest Prezes Urzędu Ochrony Danych Osobowych (art. 77 RODO).

7. Wniesienia sprzeciwu, jeżeli dane są przetwarzane do prawnie uzasadnionych celów realizowanych przez Administratora (art. 21 RODO)

Dodatkowo, jeżeli Pani/Pana dane osobowe przetwarzamy za udzieloną zgodą, to ma Pani/Pan prawo odwołać wydaną zgodę w dowolnym momencie. Odwołanie zgody nie będzie miało wpływu na zgodność z prawem przetwarzania danych osobowych, które miało miejsce przed jej odwołaniem.

Żądania należy kierować do naszego inspektora ochrony danych na adres email: iod@trefl.com. Zgodę na wysyłkę newslettera można odwołać także klikając w stosowny link zamieszczony w treści wiadomości email otrzymanej w ramach subskrypcji.


Czy podanie danych osobowych jest obowiązkowe.


Podanie danych osobowych jest dobrowolne ale niezbędne dla zamówienia usługi newsletter, dokonania zgłoszenia uczestnika na organizowane przez nas wydarzenia lub do udzielenia odpowiedzi na zapytanie przesłane w formularzu kontaktowym.


Czy przy przetwarzaniu danych osobowych stosujemy profilowanie i podejmujemy decyzję w sposób zautomatyzowany.


Przetwarzając dane osobowe użytkowników serwisu WWW nie stosujemy profilowania w oparciu o dane osobowe ani nie podejmujemy decyzji opierając się o zautomatyzowane przetwarzanie danych osobowych.

The Administrator has appointed a Data Protection Officer, who can be contacted in all matters directly or indirectly related to personal data protection:

  • by correspondence - directing enquiries to the Administrator's address, marked "Data Protection Officer",
  • by electronic correspondence to the following address: iod@trefl.com.  

For what purpose, for how long and whose personal data we process.

We process personal data for the following purposes:

Establishing contact

We process the data of persons who have submitted an enquiry to us: via the contact form, by telephone, by e-mail or by post. Providing a response is a legitimate interest of the Administrator so personal data is processed in this process on the basis of Article 6(1)(F) of the DPA. Correspondence is stored by us until the matter is resolved and the contact ends. If the subject of the correspondence was a topic that may result in a claim, then we store such correspondence for evidence purposes for a period of 12. months.

Participant registration and payment


For this purpose, we process personal data of event participants and their parents/legal guardians. The personal data is necessary for the preparation of the contract for the organisation of leisure or sports activities (depending on the nature of the event) and is taken prior to the conclusion of the contract at the request of the person who will be party to it (Art. 6(1)(B) RODO).  We process such data for the duration of the contract and thereafter until the statute of limitations for claims that may arise from the conclusion of the contract.  
Dispatch of organisational information.
We will send organisational information to the telephone number specified on the booking form by text message. The basis for processing data for this purpose is the legitimate interest of the Administrator (Art. 6. para. 1 lit. f) . If you do not wish to receive information in this form - please communicate your objection to the email address of the Data Protection Officer. We process your data for this purpose for the period of time from receipt of your booking until the end of the holiday or sporting activity or until the date on which we receive information about your withdrawal from participation.

Newsletter

If you have subscribed to our newsletter, we process your personal data for the purpose of sending the newsletter. Personal data are processed for this purpose on the basis of consent (Art. 6(1)(A) RODO) until the date of revocation or until your child reaches the age of 18.  The newsletter will also not be sent to persons who have not used the Administrator's offers for a period of 2 years - the email addresses of such persons will be removed from the mailing list.

Who may gain access to personal data.

Personal data may be disclosed to public authorities to the extent and for the purposes which result from the provisions of generally applicable law, as well as to entities which process personal data on the basis of relevant agreements signed with the Administrator:
- providers of hosting services, including e-mail and CRM software,
- service provider - sms gateway,
- to legal counsel in case of legal questions or to initiate a claim,
- website support providers.
In addition, if you make online payments for leisure or sports activities - we will share your personal data with the payment provider. The sharing of personal data is limited to the data necessary for the correct execution of the payment transaction.
Does the Administrators transfer personal data to Third Countries.

 

Whether the Administrators transfer personal data to Third States.

The Administrators only transfer to Third States anonymous information collected by cookies provided by Google LLC(list below) as part of the Google Analytics and Google Tags service.Information on the processing of this data by Google LLC is available on the website: https://policies.google.com/privacy.

What rights may be exercised by the person whose personal data we process.

At any time, you may request the exercise of your rights:

  1. access to your data to the extent specified by the provisions of the RODO (Article 15 RODO),
  2. rectification of data (Article 16 RODO),  
  3. request the erasure of the data if one of the grounds indicated by the provisions of the RODO is fulfilled (Article 17 RODO),
  4. to restrict data processing in the cases specified by the provisions of the RODO (Art. 18 RODO),
  5. data portability (Art. 20 RODO),
  6. lodge a complaint to the supervisory authority,which is the President of the Office for Personal Data Protection (art. 77RODO).
  7. lodge an objection if the data are processed for legitimate purposes pursued by the Controller (Art. 21 RODO)

In addition, if we process your personal data with your consent, you have the right to revoke the consent given at any time. The revocation of consent will not affect the lawfulness of the processing of personal data that took place before the revocation.

Is the provision of personal data mandatory.

The provision of personal data is voluntary but necessary in order to order the newsletter service, to register a participant for events organised by us or to respond to an enquiry sent in the contact form.

Do we use profiling and automated decision-making when processing personal data.

When processing personal data of website users, we do not apply profiling based on personal data or make decisions based on automated processing of personal data.
